Fuqing Wind Power – a subsidiary of Chinese power producer Zhongmin Energy – filed an arbitration claim against the wind turbine maker last year over the blades supplied to the wind farms in the south-eastern province of Fujian in 2016. The 54 G114-2.5MW turbines were supplied to Fuqing prior to the 2017 merger of Siemens Wind Power and Gamesa.

Siemens Gamesa is in a legal battle over claims concerning "root cracks and bolt damage" found in a batch of its G114-2.5MW turbines supplied to three Chinese wind farms.

According to filings with the Shanghai Stock Exchange, Siemens Gamesa was notified of the damage "many times". However, it "refused to perform its obligations under the contract", Fuqing claimed.

As a result, Fuqing has refused to finalise the payment.

Siemens Gamesa has now filed a countersuit, according to a stock exchange notification filed by Zhongmin Energy.

Siemens Gamesa claims that the two-year warranty period for the blades has ended, and Fuqing Wind Power has not completed the final acceptance process or paid the remaining warranty money.

Windpower Monthly has contacted Zhongmin Energy for comment.

The total disputed amount exceeds CNY 186 million ($25 million), with Siemens Gamesa’s counterclaim reaching CNY 31.6 million ($4.3 million) in unpaid warranty fees.

A Siemens Energy spokesperson said: “It is well known that we take responsibility and honour our commitments, and in this case, we are actively defending against the allegations.

"At this time, we cannot provide further comments on the ongoing legal arbitration. However, the wind turbines at this site are currently operating at a high level of availability.”

The arbitration case has not yet gone to trial. Initially, three separate cases had been lodged, but they have now been merged into one.
