OPSB calls for comments on proposed rules, denies Defiance County solar project

The OPSB denied the application filed by Cepheus Energy Project, LLC to construct a 68 megawatt (MW) solar-powered electric generating facility in Delaware Township and Sherwood Village, Defiance County. The OPSB found that, based on the unanimous opposition to the project by local governments whose constituents are impacted by the project, the proposed project would fail to serve the “public interest, convenience, and necessity” as required by Ohio law.

COLUMBUS, OHIO – The Ohio Power Siting Board (OPSB) today issued draft modifications to its rules for public comment. The OPSB requests that interested persons submit comments by Jan. 30, 2023 and submit reply comments by Feb. 6, 2023.

Specifically, the OPSB staff recommends changes to certain definitions in Ohio Administrative Code 4906-1- 01, the site/route information that is required of applicants in Ohio Administrative Code 4906‑3-05, and the facility setback requirements in Ohio Administrative Code 4906-4-09.

In separate business, the OPSB denied the application filed by Cepheus Energy Project, LLC to construct a 68 megawatt (MW) solar-powered electric generating facility in Delaware Township and Sherwood Village, Defiance County. The OPSB found that, based on the unanimous opposition to the project by local governments whose constituents are impacted by the project, the proposed project would fail to serve the “public interest, convenience, and necessity” as required by Ohio law. The OPSB noted that all three local governments in the Cepheus Energy Project area – the Village of Sherwood, the Defiance County Board of Commissioners, and the Delaware Township Trustees – opposed the project and that the public comments filed in the case, which largely disfavor the project, reinforce the local government opposition.
