Selectmen exploring Cape Wind comments

Yarmouth Selectman William Marasco successfully requested that the town look into recent comments by Cape Wind Associates, the would-be-developer of a wind farm in Nantucket Sound.


While being careful not to break any agreements himself, Marasco said he had recently seen media reports involving Cape Wind in which the host agreement between the developer and Yarmouth was discussed. The 2003 agreement, which could bring an estimated $9 million to the town over a 20-year period, stipulates that neither developer nor town can refer to the agreement in a paid advertisement. It also makes clear that the agreement does not preclude officials from taking any other actions regarding the wind farm and that neither party can state that the agreement constitutes support for the wind farm.

In September 2004, Town Administrator Bob Lawton reiterated the board's position against the project but said the host agreement is intended to protect the town financially should the project be built.
 
The host agreement represents mitigation because the wind farms transmission cables would need to be built under Yarmouth roads.
 
Marasco's request was that the board see if there had been a breach of the contract and, if so, is there any remedy the town could take.
