Appeals court okays EIR for Mojave-area wind farm

The environmental impact report (EIR) for a proposed 80-turbine wind farm near Mojave is adequate, an appeals court has ruled, clearing the way for construction to begin. In approving the EIR, the 5th District Court of Appeal in Fresno rejected the arguments of the Kerncrest and Los Angeles branches of the Audubon Society. The court also ordered the Audubon society to pay legal bills incurred by the Los Angeles City Department of Water and Power (LADWP).

The LADWP plans to build a wind farm and eight miles of transmission line in the hills north of Mojave and northeast of Tehachapi. The land is now used for cattle grazing.
The electricity produced would go to Los Angeles.

The Audubon Society asked the Kern County Superior to stop the project. When Judge Kenneth C. Twisselman refused, Audubon went to the appeals court, which ruled Twisselman was right.
The Audubon Society said the Environmental Impact Report on the plan didn't consider the danger to song birds that fly at night. It complained the EIR didn't consider the impact of the added growth in Los Angeles that the electricity would make possible.
