Representative Mollohan's Letter to the Public Service Commission of West Virginia

Mollohanjul26_thumb WV's Congressman Mollohan submitted a letter on July 26, 2006 to the WV Public Service Commission (PSC) concerning the Beech Ridge wind energy project proposed for Greenbrier County, WV by Chicago-based Invenergy, Inc. This wind energy developer successfully pushed through a windplant in Wisconsin nearby the Horicon Marsh - a globally-significant wildlife area and National Wildlife Refuge - despite the widespread outcry by national and local wildlife groups who opposed such close siting. Mollohan's letter points out that Invenergy disregarded recommendations by the US Fish and Wildlife Service for multi-year pre-construction studies regarding the project's potential impacts on migratory birds and bats. He also observed that although WV's one operating wind project in Tucker County has been the site of record-setting bat mortality due to collision with turbine blades, the project operator (FPL Energy) has cut off access to the site for scientific study or investigation, even by the National Research Council/National Academies committee charged by the U.S. Congress to study the environmental impacts of wind projects in the Mid-Atlantic Highlands (see footnote #2 in his letter).

Glebe Mountain Group: Comments To Windham Region Planning Commission Regarding June 12, 2006 Draft of Regional Plan

Comments_to_windham_regional_commission_thumb Vermont regional commissions are responsible for updating their respective 'plans' every five years. The Windham Regional Commission (WRC), comprised of representatives from the 27 towns in Windham County, submitted a draft of its updated plan for public comment in late June 2006. Given the prevailing public concerns regarding energy, the energy section of WRC's draft plan was of particular interest. Specifically, the Glebe Mountain Group, an incorporated non-profit organization that has been actively engaged in protecting Glebe Mountain from industrialization, felt is was imperative that industrial wind generation projects not be encouraged or accorded any presumption that they serve the public good. The Glebe Mountain Group's comments on the plan are attached as is the original 'draft' WRC plan. Some of the specific comments related to wind energy are extracted below as is the conclusion. These comments were fully endorsed by The Friends of Glebe Mountain, an unincorporated 100% volunteer group comprised of residents of and non-resident property owners in the towns of Londonderry and Windham.

Examples of wind easements and land leases

Options_for_wind_easements_and_leases_thumb Attached are complete land lease and lease options from Zilkha, Enron, Green Light, and Ecogen wind developers. Also attached is a summary written by Save Upstate NY that describes some aspects that all four have in common. Subsequent to the posting of these items an example of a PPM Energy lease for the Flatrock Wind Farm (i.e. Tug Hill) was added.

Whinash Decision Documents

Whinashwindfarm_thumb The Secretary of State accepts the Inspector’s [David M H Rose] findings on the section 36 application. He agrees with the Inspector’s conclusions that the Whinash site is an important and integral part of a far reaching landscape which is highly sensitive to change and that the adverse environmental impacts of the Development would conflict with the aims of Planning Policy Statement 22 which is, in part, to minimise the impacts of wind generation and to achieve environmental safeguards. He also agrees with the Inspector’s conclusion that the environmental harm to this particular landscape outweighs the benefits of securing renewable energy at the Whinash site. The Secretary of State therefore accepts, taking account of the further comments below, the Inspector’s recommendation that consent be refused. Vermont Public Service Board: Hearing Officer's Recommendation re. East Haven Windfarm

Hearing_officer_east_haven_thumb For the reasons set forth.., I conclude that the proposed Project will not promote the general good of the state. Therefore, I recommend that the Board not issue a Certificate of Public Good for the proposed Project. However, if the Board does issue a CPG, I recommend that it include the conditions outlined in this Proposal for Decision.

Abilenetxlawsuit_thumb The Plaintiffs acquired their properties with the intent of country living, enjoying the wildlife on their properties, some hunt on their properties, some let others hunt on their properties yet the Plaintiffs have suffered the following effects from the erection of the turbines: significant loss of use and enjoyment of their properties, negative impacts on the wildlife on their properties, interference with the ability to hunt and have others hunt on their properties, interference with the electrical functioning of their homes such as satellites, televisions, and the circuitry, destruction of the scenic countryside, a diminishing of the use of the properties for outside functions, lights, noise, trespass by the Defendants onto their properties, damage to their homes from dynamite blasts, cutting down trees by the Defendants on a Plantiff's property, concern for the health impacts of living under turbines, dread, fear and the loss of the previous love for their homes. The Public as well has suffered a loss from the destruction of this scenic and historic area of Taylor County and the complete disregard of FPL Energy, LLC for the endangered species in the area when it constructed Callahan Divide Wind Farm.

Cumulative Impact of Wind Farms In The Outer Clyde Estuary

Cumulativeimpact_thumb A study of the Outer Clyde Estuary, covering Kintyre, Cowal, Arran, Bute, Inverclyde and North Ayrshire, conducted by AWF, demonstrates the huge and increasing pressure on the area from wind farm developers. It concludes, that if all the wind farms in or approaching the planning system at present are approved, the level of cumulative impact will degrade the environment of this unique area to a totally unacceptable extent. It would not be an exaggeration to state that every transport route (road or ferry) would have a prominent view of at least one wind farm. The need for a strategic review is overwhelming.

Fgeis_rev1_thumb This Final Generic Environmental Impact Statement (FGEIS) has been prepared for the Ecogen, LLC (Ecogen) Prattsburgh/Italy Wind Farm Project (Project) on the behalf of the Lead Agency, the Steuben County Industrial Development Agency (SCIDA). The FGEIS is prepared pursuant to the New York State Environmental Quality Review Act (SEQR), Environmental Conservation Law, Article 8, 6NYCRR Part 617, and its implementing regulations.

Landscape Classification System

A_landscape_classification_system_thumb A Landscape Classification System report, maps and GIS files is now available as an aide to "environmentally responsible siting of utility-scale wind projects in Virgina." The report and associated materials was a collaborative product of Dan Boone, Judy Dunscomb, Rick Webb and Christina Wulf, who worked on this project on behalf of The Nature Conservancy, Virginia Society of Ornithology and Virginia Forest Watch. Rick Webb and Dan Boone have created a website - www.VAwind.org - to disseminate this report and related information. They "are guided by the Precautionary Principal, wherein if we have reasonable suspicion of harm, accompanied by scientific uncertainty, then we all have a duty to take action to prevent harm." They "remain hopeful that the wind industry will embrace the principle of precaution and stand as a role-model for other industries by taking strong and proactive steps to prevent environmental harm" and "intend to continue work on the Landscape Classification System and to promote effective assessment of environmental issues related to wind energy development."

Jurisdictional Ruling by Vermont's Environmental Board

Jurisdictionalopinion2-227_thumb The Windham Regional Commission asked the District Environmental Commission if the proposed commercial wind energy development on Glebe Mountain requires an an Act 250 amendment as well as a permit under Section 248 (30 V.S.A Section 248). Act 250 is designed to protect Vermont's ridgelines above 2500'. Section 248 authorizes the Public Service Board to issue 'Certificates of Public Good' for electricity generating projects. The District Environmental Commission concluded that construction of the wind measurement towers and the proposed wind energy project represent material and substantial changes to existing Act 250 permits and thus require an amendment.

The Aesthetic Dissonance of Industrial Wind Machines

Aesthetics_of_dissonance_1__thumb In a paper recently published on line on September 28,2005 in "Contemporary Aesthetics", Jon Boone responds to Yuriko Saito's "Machines in the Ocean: The Aesthetics of Wind Farms" by arguing that Saito's search for the right aesthetic justification for windplants sited in the ocean (as well as on shore) is predicated on a false assumption, i.e. that industrial wind power is both benign and effective.
