European Court of Justice ruling against Government of Bulgaria

Europeancourt-bulgaria_thumb The European Court of Justice has ruled against Bulgaria in a case brought by the European Commission against the country over its failure to protect unique habitats and important species in the Kaliakra special protection area at the Black Sea coast, the court announced on January 14 2016. Projects such as wind turbines, a golf course, spa and hotels have been approved and built in the area by Bulgarian authorities, despite the likelihood it would lead to significant disturbance of these protected species. As a result, the court has found Bulgaria to be breaching the EU’s Birds and Habitats Directives. A portion of the ruling is below. Wind Farm Impacts Study: Review of the visual, shadow flicker and noise impacts of onshore wind farms

Final_report_wind_farm_impacts_study_july_2015_issue_thumb This study looked at whether the visual, shadow flicker and noise impacts predicted by wind farm developers in documentation submitted with their planning applications are consistent with the impacts experienced once the wind farm is operational. Through an examination of 10 wind energy facilities, the authors concluded that in some cases the impacts described in the planning applications did not match the actual impact. Scottish Natural Heritage: Visual Representation of Wind Farms 2014

Visual-representation-of-wind-farms-july2014_thumb The Scottish Natural heritage (SNH) has published ‘Visual Representation of Wind Farms, July 2014’. This guidance replaces the previous version (2006). The updated guidance sets a new standard for wind farm visualizations; and is prescriptive which means that applicants must comply with the key requirements set out in Annex B of the guidance. Court of Appeal confirms parliamentary intention overrides an exercise of expert judgment

Developers should also be aware that the case clarifies the way in which the planning balance must be struck by decision makers.  They are not free to give harm to heritage assets such weight as they may choose when carrying out the balancing exercise.  Instead, they must give particular weight the desirability of avoiding such harm when assessing whether the advantages of the proposal outweigh that harm. The rejection of the "reasonable observer" test will also be a significant constraint on the ability to construct wind farms and other new development in sensitive locations.

Renewable Energy on the National Forest Estate

The report, obtained through a freedom of information act, shows how FCS divided the public land it manages into 5 'lots' to be prospected by specific wind energy developers. For example, ScottishPower Renewables were awarded Lot 1 and the right to develop schemes of less than 5MW in Lots 1-5. The remaining 4 lots are allocated to four other developers all of whom are currently working through the exclusivity period to identify suitable sites for wind turbines.

The Visual Issue - An Investigation into the Techniques and Methodology used in Windfarm Computer Visualisations

The_20visual_20issue_thumb This document does not question whether we should be developing windfarms or should not be developing windfarms, or even whether they look good on a landscape or are a visual intrusion on the landscape. We are simply addressing the methodology used by the windfarm industry, who in our opinion, have been using misleading methods for the last 11 years whilst seeking to obtain planning permission. Having had more than 15 years experience in producing visualisations for planning applications, both here and in other parts of the world, what we see happening throughout Scotland and the rest of the UK is a method of visual presentation which brings our profession into disrepute. After many years of fighting for fairer standards, something has to be done because of the growing public perception that photomontage is unreliable.

Mynydd-y-Gwrhyd Planning Inspector's Report

Gwrhyd_appeal_thumb This is the report submitted by the Planning Inspector appointed by the National Assembly for Wales that dismisses the appeal by the Awe Amman Tawe quango for a wind farm on Mynydd-y-Gwrhyd. Of particular interest are the Inspector's remarks on Landscape and Visual Impact (paragraphs 16-20 on pages 5-6) with respect to how 'developers photomontages' do not give the true visual impact of actual wind farm sites.

Whinash Decision Documents

Whinashwindfarm_thumb The Secretary of State accepts the Inspector’s [David M H Rose] findings on the section 36 application. He agrees with the Inspector’s conclusions that the Whinash site is an important and integral part of a far reaching landscape which is highly sensitive to change and that the adverse environmental impacts of the Development would conflict with the aims of Planning Policy Statement 22 which is, in part, to minimise the impacts of wind generation and to achieve environmental safeguards. He also agrees with the Inspector’s conclusion that the environmental harm to this particular landscape outweighs the benefits of securing renewable energy at the Whinash site. The Secretary of State therefore accepts, taking account of the further comments below, the Inspector’s recommendation that consent be refused. Cumulative Impact of Wind Farms In The Outer Clyde Estuary

Cumulativeimpact_thumb A study of the Outer Clyde Estuary, covering Kintyre, Cowal, Arran, Bute, Inverclyde and North Ayrshire, conducted by AWF, demonstrates the huge and increasing pressure on the area from wind farm developers. It concludes, that if all the wind farms in or approaching the planning system at present are approved, the level of cumulative impact will degrade the environment of this unique area to a totally unacceptable extent. It would not be an exaggeration to state that every transport route (road or ferry) would have a prominent view of at least one wind farm. The need for a strategic review is overwhelming.
