Independence turbine in Kingston could be suspended

With no progress toward securing payments due the town of Kingston, the owners of the Independence wind turbine have been given a 30-day deadline to pay up or risk suspension of site plan approval.

KINGSTON – With no progress toward securing payments due the town of Kingston, the owners of the Independence wind turbine have been given a 30-day deadline to pay up or risk suspension of site plan approval and for all approved activities to cease.

Failure by turbine owner Kingston Wind Independence to pay taxes and other municipal charges including overdue rent are cited as the reasons for the Planning Board’s decision Monday night to order suspension of site plan approval if no significant progress is made after another 30 days.

The decision states, “should the town administrator report to the Planning Board that there is sufficient progress in negotiations with KWI for payment of overdue charges, the suspension should be further delayed for an additional 30 days and provided further if there is not a binding agreement deemed satisfactory to the town administrator by the end of such 30 days the permit shall be suspended indefinitely.”

The suspension would only be lifted by vote of the Planning Board.

Town Planner Rob Downey said town counsel has reported no progress so far and recommends suspending site plan approval. It’s also Downey’s recommendation. The other options were revocation of site plan approval and taking no action.

The Planning Board approved the site plan for the Independence wind turbine in June 2010.
