Appraisal district files lawsuit over wind farm property

The lawsuit filed by the appraisal district asks the judge “cancel and set aside the decision of the appraisal review board” and that “an order be entered fixing, in accordance with the law, the market value of the (wind farm), as required by law.”

Val Verde County Appraisal District Chief Appraiser Cherry Sheedy has filed a lawsuit asking a state district judge to set aside a decision by the Val Verde County Appraisal Review Board to lower the appraisal of a Val Verde County wind farm.

As directed by the Val Verde County Appraisal District board of directors, Sheedy filed the suit through the appraisal district’s attorneys, McCreary, Veselka, Bragg & Allen of Round Rock, Texas. The lawsuit was filed Sept. 13 against Rocksprings Val Verde Wind, LLC, in 63rd Judicial District Court.

It reads that in May, the Val Verde County Appraisal District mailed a notice of appraised value to the Rocksprings Val Verde Wind, informing its owner that the wind farm’s proposed value had been set at $176,454,480.

The notice, attached as an exhibit to the lawsuit, also estimated the taxes based on the proposed $176 million value: $2,046,519.06 for the San Felipe-Del Rio Consolidated Independent School District, a total of $1,024,092.11 for Val Verde County and $190,041.47 to the Val Verde County Hospital District.

Val Verde County Appraisal District Chief Appraiser Cherry Sheedy has filed a lawsuit asking a state district judge to set aside a decision by the Val Verde County Appraisal Review Board to lower the appraisal of a Val Verde County wind farm.

As directed by the Val Verde County Appraisal District board of directors, Sheedy filed the suit through the appraisal district’s attorneys, McCreary, Veselka, Bragg & Allen of Round Rock, Texas. The notice, attached as an exhibit to the lawsuit, also estimated the taxes based on the proposed $176 million value: $2,046,519.06 for the San Felipe-Del Rio Consolidated Independent School District, a total of $1,024,092.11 for Val Verde County and $190,041.47 to the Val Verde County Hospital District.

“On ... June 19, the defendant (wind farm) filed a notice of protest asserting both that the subject property was appraised in excess of its market value and unequally when compared to other properties,” the appraisal district’s lawsuit reads.

It notes that on July 17, the appraisal review board (ARB), whose members are appointed by the Val Verde County Appraisal District Board of Directors, but who operate independently of the board, held a hearing on the wind farm’s protest.

“The ARB issued a final order, determining the subject property’s 2018 tax year appraised value to be reduced to $101,400,000 ... the plaintiff (Sheedy) alleges that the subject property’s value, as set by the Val Verde County Appraisal Review Board, is far lower than the subject property’s actual market value as of Jan. 1. The plaintiff alleges that the subject property’s market value on Jan. 1 greatly exceeded $101,400,000 which was the value as determined by the Val Verde County Appraisal Review Board,” the lawsuit reads.

The lawsuit filed by the appraisal district asks the judge “cancel and set aside the decision of the appraisal review board” and that “an order be entered fixing, in accordance with the law, the market value of the (wind farm), as required by law.”

As of press time Friday, a spokesman for the district clerk’s office said no hearing has been set in the case.
