SJC denies Falmouth petition to review turbine case

The state's Supreme Judicial Court has denied a petition by the town of Falmouth to review a zoning case concerning the town's controversial wind turbines.

FALMOUTH — The state's Supreme Judicial Court has denied a petition by the town of Falmouth to review a zoning case concerning the town's controversial wind turbines.

The town has claimed it didn't need zoning approval when, in 2009, it installed two turbinesat its wastewater treatment plant. Neighbors disagreed and took Falmouth to court over the matter. Barnstable County Judge Robert Rufo ruled in the town's favor, but the decision was overturned by the Court of Appeals.

Wednesday, the SJC declined to review the matter, according to court records. That means the case will go back to Rufo's jurisdiction for a new ruling.

Town Counsel Frank Duffy declined to comment this morning, saying that Town Manager Julian Suso would be issuing a news release today.
