The state Legislature will try again to establish statewide wind farm standards. Since the last legislative session ended with a failed attempt to approve standards, several local townships created wind farm ordinances on their own and thus thumbing their noses at the state, and doing an end around, bottom line not following the chain of command.
Township of Ridgeville Chairman Mike Luethe made the following statement to the Daily Reporter newspaper on Aug. 15, 2008: "The Town of Ridgeville joined the Township of Wilton in passing an ordinance establishing half-mile setbacks for wind farms. Local governments should still have a say in the matter. Invenergy LLC of Chicago, which wants to develop a wind farm in the area, already challenged in court the joint Ridgeville-Wilton ordinance." "They said we do not have the right to pass our own ordinance," Luethe said, "because it essentially vetoed the county's own ordinance."
I wish to ask Mr. Luethe what was the court date, court docket number and which judge was assigned? And you know why does the formal challenge not show up on the WCCA website? And lastly, why does the Clerk of Court know nothing about this case? As you read this letter, remember the above statement from Mr. Luethe is based on the new wind farm ordinance just drafted. The current court case about the wind farm project before the Monroe County Court has been ongoing and has nothing to do with the new ordinance, therefore Mr. Luethe, fact or fiction?
