Iberdrola suspends local application for Clayton wind farm, will seek an Article X process instead

Clayton Supervisor Justin A. Taylor said that while the town does not have a problem with Iberdrola seeking an Article X process, it certainly hopes the developer "will strongly take into consideration our town of Clayton ordinance, and our setbacks and decibel limits."

The Copenhagen Wind Farm project, to be sited north of the 195-turbine Maple Ridge Wind Farm, will be located on up to 62 private parcels in the town of Denmark. While the scoping document cites a maximum generating capacity of 102 megawatts, Mr. Damon said the expected limit remains at 80 megawatts, or up to 49 turbines.

The decision comes as the result of an Article 78 lawsuit brought by diverse group of 34 petitioners from the Towns of Richfield, Winfield and Columbia to stop the project. In addition to annulling the permit, Judge Cerio ordered the Town of Richfield Planning Board to attend training by the Committee on Open Government, which will also be open to the public.
