Quechan contends the project will cause irreparable harm to hundreds of cites including burial and cremation sites, as well as tens of thousands of artifacts. Forensic dog teams hired by tribes last week found six new cremation sites. Tribal members, who in modern times have continued to use the site for ceremonial purposes, also sought to protect views of mountains sacred in their religious beliefs of creation.
An Alameda County Superior Court judge has dismissed a lawsuit against wind-farm operators in the Altamont Pass that claimed windmill operators had violated state law by killing migratory birds in the area.
Judge Bonnie Sabraw ruled Thursday the operators were not in violation of the states unfair competition law because the Center for Biological Diversity, which filed the suit in 2004, did not lose property or money. The center had claimed the birds were part of the public trust and therefore wildlife property of the public.

U.S. District Court Judge William Hayes dismissed a lawsuit filed by Community Advocates for Renewable Energy Stewardship (CARES). The group sought an injunction to halt construction of the Ocotillo Express wind energy facility on public land.

The Marin County Civil Grand Jury is asking officials to pull the plug on their proposed Marin Clean Energy program, a plan designed to reduce greenhouse gas emissions ...The jury's report states that the costs of the program create too high a risk for ratepayers and taxpayers alike, lacks a transparent citizen vote, and will install a new level of bureaucracy that has little or no experience with energy management.
