W.Va. PSC dismisses turbine noise complaint; Residents can take issue to circuit court

Should the Braithwaites decide to pursue the matter further, they could file a nuisance claim in circuit court, according to the PSC document. Gary Braithwaite, along with 26 families, have hired a lawyer and are discussing the possibility of filing a suit for damages, according to the State Journal.
Trustee Mike DeMarco admitted the Village Board's Planning and Plats Committee felt it was necessary to study the issue more before any decisions could be made about how to regulate the use of wind energy by residents or large-scale users.
"Our ordinances do not have any height restrictions for wind power," DeMarco said. "They are more related to windmills than wind turbines."

A lawsuit over a controversial bylaw related to a wind turbine development in Wainfleet is now in the hands of a judge.
Wainfleet Mayor April Jeffs said she expects to hear a verdict in the next four to six weeks over whether a two-kilometre setback bylaw enacted by her town council will be allowed to stand.

Residents will have to wait until Monday, Dec. 1 to hear more about the proposed Graham Waste wind turbine project. Last Thursday, the applicant, Jim Sweeney of CCI Energy, formally requested the public hearing set to continue on this past Monday, Oct. 27 be postponed to allow him to collect further data. In anticipation of the planned public hearing last week, talk and opinion of the wind turbines were blowing around.

A rules and regulatory reform bill proposed Tuesday by Gov. Scott Walker would require wind turbines to be set back at least 1,800 feet from nearby properties, unless those property owners consent in writing.
The bill also would require any agency's proposed rule to go through the governor's office before it can take effect, and expands the economic impact reporting requirements for proposed agency rules.

After consulting with Village President Robert Brasen and reviewing current maps, LeSage recommended limiting wind turbines in the 1 to 1.5 mile range to the industrial use areas on the northwest and southeast areas of the village.
Brasen said those areas would go along with the village's future plans, which would likely continue industrial growth in those areas.

The village of Walnut has drawn a line in the sand, and it’s about 1.5 miles outside the village limits.
At Monday’s village board meeting, trustees approved two motions to regulate the construction of wind turbines near the village limits.
At its Feb. 8 meeting, the county board heard a written statement from a group of Walnut area residents opposing the Walnut Ridge extension requests. In its statement, the group asked the county board to deny any extension ...until the county board could do further study of existing data on what the group called "the very real and adverse affects" of wind turbines.
Porter said a lot of new information has been learned about wind farms since Bureau County issued the three-year Walnut Ridge conditional use permits in 2008, in the months of August, November and December.
Bureau County needs to go back to its zoning ordinances and stipulations before going ahead.
MONMOUTH - Warren County leaders want to be prepared if a wind energy developer decides to build turbines in the region.
With a wind energy developer interested in Warren County, zoning officials spent the last several months researching the issue and creating an ordinance that regulates wind energy systems. The Warren County Board unanimously approved the ordinance Wednesday.

Acciona Energy announced the purchase of Trish and Victor Godfrey's five-acre property yesterday for an undisclosed amount.

University of Ballarat engineering lecturer Graeme Hood said the Victorian Government should commission a comprehensive independent investigation to determine exact levels of inaudible sound produced, after his own study proved inconclusive. ...Mr Hood said his research found that an audible swishing noise emitted by the turbines ranged between 60dB, or the equivalent of conversational speech, and 80dB, or the equivalent of average street traffic.
