Xcel's legal filing claims New Era agreed to pay delay damages if it did not meet various milestone dates. That language was approved by the PUC in 2010 for two 39-megawatt contracts.
Additionally, Xcel's lawsuit claims that New Era was required to establish a security fund totaling $5.85 million ...the fund was never created.

The Vermont Department of Public Service recommended that state utility regulators find the Lowell wind project in violation of its operating certificate for exceeding noise limits four times last winter.
However, the department asked the Vermont Public Service Board not to impose sanctions right away on Green Mountain Power, which operates the Lowell wind project, to give GMP time to remedy the problems that caused excessive noise, according to filings with the board.

The company paid $418 million to acquire Beit Shemesh, Israel-based Solel Solar Systems in 2009 as Loescher sought to replicate Siemens' successful expansion into wind-power and win more revenue from its so-called green portfolio. The project could meet an obstacle in the form of Brownsville South Padre Island International Airport's plans to extend its runway ...A longer runway would mean planes on approach would fly lower farther away from the airport, which could preclude construction of towering wind turbines.

"The eagle is a sacred and symbolic figure to the Osage people, and the area targeted for this project contains a high bald eagle population. We oppose the specific area for this project. It all comes down to siting projects in appropriate places, and this is not an appropriate place for a massive wind energy project."
The permit application acknowledges that up three bald eagles a year could be killed by the development over the 40-year life of the project.
"I can't come up with the words in English or Osage to put a value on how important these (eagles) are to us and to our everyday survival," said Scott BigHorse, assistant chief for the Osage Nation.
Linda Holt, of Scotland Against Spin, hit out at a plan to get local pupils to name 21 wind turbines at the Baillie wind farm.
"I feel very strongly that children should not be used in what is a propaganda war. They should not be involved," she said.

The 102.5-megawatt Shiloh IV Wind project applied for its take permit in March 2012, and the other three projects have applied in the last six months.

A Superior Court judge has ordered town planners to reconsider two items - tower heights and sound levels - from its October 2011 approval of Pisgah Mountain wind farm, and the local panel decided Wednesday not to allow public comment during the remand process.
"It was considered that the repair costs and ongoing maintenance issues meant that it was no longer viable and sustainable to keep the turbine.
"However, the council remains committed to sustainable technology, and continues to look at options for the future."
Richmond County and Scotian Windfields have reached a settlement which will allow a plan to build a wind turbine on Isle Madame to go forward.
The project has been in the works for five years, but the county and the company were in a dispute over rezoning for the turbine.
The DEP had concerns that the proposed 275-foot wind turbine might exceed sound limit guidelines during the winter. So, the agency recommended three possible actions be taken: The applicant could withdraw its proposal without prejudice; recommend the Zoning Board of Appeals deny the requested special permit for the project; or Stop & Shop Supermarket Company LLC could implement mitigation measures.

A new wind energy tax incentive signed into law last week was touted as a way to lure a wind farm worth hundreds of millions of dollars to Nebraska, but that's no sure thing.
The sponsors of the wind bill say the incentive has already drawn the interest of wind energy development companies, but there is no guarantee that the $300 million to $400 million wind farm will come here.
Randolph County is in the running, but not Delaware County, for a wind farm or wind farms that would sell electricity to Indiana Michigan Power.
