LIBERTYVILLE -- Opponents of a wind turbine adjacent to a residential neighborhood won an extension of a temporary restraining order to keep the turbine turned off until July 14.
"It was a slam dunk for the judge," said Dave Gates, spokesman for the group Citizens for the Protection of Libertyville, after a hearing Monday morning. They are fighting Aldridge Electric. The company declined comment.
On July 14, the neighborhood group will seek a preliminary injunction to keep the turbine turned off.
"At that hearing we will be expected to present our evidence that we are being harmed by the noise of the turbine," Gates said.
He said an offer was made by Aldridge to keep the wind turbine turned off at night, which only irritated members of the group, who live nearby and complain of the noise and reflection from the turbine, which can be seen above the tree line just off of Rockland Road near the Des Plaines River bridge.
The group now has a Web site at www.windturbinenoises.org . They are trying to collect 1,000 signatures to ask village officials to reconsider the five special ordinances passed to allow the wind turbine 250 feet from adjacent homeowners' property lines.
"The village only had one meeting and a representative said it would not be louder than a refrigerator. That was a lie," Gates said.
The village was represented at the court hearing and told the court they had no opinion on the issue.
"Our big issue now is how do we raise money," Gates said, adding the homeowners have agreed to the company's request to occasionally turn the turbine on when showing it to potential customers.
The turbine generates enough power to run two homes.
