A Bingham County judge granted a motion today delaying the construction of 150 wind turbines in Wolverine Canyon, even though the plan was approved by the Bingham County Planning and Zoning Commission.
Thursday afternoon Judge Richard St. Clair granted two motions filed by groups opposed to the project. One of those motions will extend the discovery period, meaning the soonest oral arguments will be heard is end of July.
The motion was filed to give opponents of the project time to investigate whether or not the county gave adequate notice for the public hearings.
A lot of this argument is based on the placement of signs on 20,000 acres of land in the Wolverine Canyon where 150 wind turbines would be built.
These signs were to give the public notice of the upcoming hearings but opponents of the wind farm say there may not have been any on the property at all.
The county's zoning ordinance requires at least one of those signs be placed on the property that will be affected by the zoning changes.
Attorneys for Ridgeline Energy argued the public was given plenty of notice for the hearings on signs around the area and in local newspapers and that these delays don't serve justice.
The other motion was to admit the planning and zoning bylaws into the court's record.
That motion was also approved by Judge St. Clair.
This appeal was filed in August of last year and it could be August of this year before the court reaches a final decision.
