NH Superior Court has found that the Town of Antrim was in viloation of the State's Right to Know law by conducting numerious unnoticed, non-public meetings to negotiate the PILOT agreement between the Town and Antrim Wind LLC, a company seeking to erect a wind energy facility in the Town. The New York State fleet of wind turbines with an installed capacity of 1,634 megawatts, on average across all projects, operated at under 25% annual capacity factor since 2009.

This letter was sent to the Minnesota Public Utilities Commission in reference to the Goodhue Wind project proposal now known as the New Era Wind Farm. New Era explains that it has initiated discussions to assign its power contracts to a third-party wind project developer and site. It further requests that any further evidentiary procedures with respect to the the project before the PUC be placed on hold. It appears from the letter that the project will be sold or canceled.
Environmental groups and residents of Nevada have filed a complaint in U.S. District Court of Nevada challenging the Department of the Interior's permit granting Duke Energy permission to construct an 87-turbine wind energy facility east of Searchlight on 19,000 acres of Bureau of Land Management land. The plaintiffs argue that Former Interior Secretary Ken Salazar acted in a manner that was arbitrary, capricious, an abuse of discretion and contrary to law. The Wildlife Society's March Bulletin included this impacting paper by Dr. Shawn Smallwood who compares post-construction bird and bat fatality assessments conducted across the United States. He estimates 888,000 bat and 573,000 bird fatalities/year (including 83,000 raptor fatalities) at 51,630 megawatt (MW) of installed wind-energy capacity in the United States in 2012. As wind energy continues to expand, there is urgent need to improve fatality monitoring methods and address the levels of mortality.

This notice provides two methods that a taxpayer may use to establish that construction of a qualified facility has begun. A taxpayer may establish the beginning of construction by starting physical work of a significant nature as described in section 4. Alternatively, a taxpayer may establish the beginning of construction by meeting the safe harbor provided in section 5 (Safe Harbor). Although a taxpayer may satisfy both methods, a taxpayer need only satisfy one method to establish that construction of a facility has begun for the purpose of qualifying for the PTC or ITC.
