Sixty-day notice of violations of ESA etc. regarding proposed Cape Wind offshore energy facility
March 15, 2010
by Jessica Almy and Eric R. Glitzenstein
This 60-day notice of violations of the Endangered Species Act, the Outer Continental Shelf Lands Act, and other laws, was filed with the U.S. Department of the Interior in connection with the proposed Cape Wind offshore wind energy facility. The detailed notice and supporting appendices explain fundamental failures of the Minerals Management Service, the U.S. Army Corps of Engineers, and the Fish and Wildlife Service to adequately assess the risks to the natural environment and to protected and endangered species.
The perils of picking technological winners in renewable energy policy
March 5, 2010
by Michael J. Trebilcock and James S.F. Wilson
Wind energy on the Pacific Northwest’s electricity grid has increased substantially. Often overlooked are the impacts of increasing wind generation on the reliability and affordability of electricity that very well might outweigh any of the promised environmental benefits. Todd Wynn and Eric Lowe explain how in Oregon wind power simply replaces a clean, reliable and affordable source of energy: hydroelectricity while inviting increased price volatility, increased rates, and the prospect of more greenhouse gas-emitting facilities.
Potential climatic impacts and reliability of very large-scale wind farms
February 22, 2010
by C. Wang and R. G. Prinn
Meeting future world energy needs while addressing climate change requires large-scale deployment of low or zero greenhouse gas (GHG) emission technologies such as wind energy. The widespread availability of wind power has fueled substantial interest in this renewable energy source as one of the needed technologies. For very large-scale utilization of this resource, there are however potential environmental impacts, and also problems arising from its inherent intermittency, in addition to the present need to lower unit costs.

Real estate appraisal experts are challenging the scientific credibility and accuracy of a recent US Department of Energy ('DOE') report on the effect of wind power projects on property values. Albert R. Wilson's new paper asserts that well known flaws in the methodology used in the study raise serious questions concerning the credibility of the results, and the DOE report's authors failed to follow well-developed and tested standards for performing regression analyses on property sales. His paper can be accessed by clicking on the links at the bottom of this page.

Stormwater appeal final brief - Sheffield Wind
February 4, 2010
by Stephanie J. Kaplan, Esq. and Jared M. Margolis, Esq.
Individual members of the grassroots group Ridge Protectors Inc., filed an appeal in Vermont's Environmental Court arguing that more ground would be disturbed by the Sheffield wind facility than was approved in the storm water discharge permit issued by the State's Agency of Natural Resources (ANR). The wind developer, First Wind has been approved by the Vermont Public Service Board to erect sixteen 2.5 megawatt wind turbines along a ridgeline in Sheffield, Vermont. The final brief filed by the Ridge Protector appellants can be accessed by clicking on the link at the bottom of this page. An excerpt of the brief is posted below.
It has become well known by those in the energy industry that wind industry officials and lobbyists continue to understate the full and true cost of electricity from wind and have been successful in creating a false “popular wisdom” about wind energy.
Energy analyst Glenn Schleede takes the gloves off and explains the real story behind wind energy's price and how it's high cost fails to match the value of the electricity produced.

Resolution: West Grey Seeks Moratorium on Industrial Wind Turbines
January 29, 2010
by Municipality of West Grey
As Mayor of the Municipality of West Grey, on behalf of the Council and citizens of West Grey, I am calling upon the Province of Ontario to place an indefinite moratorium on industrial wind turbines in the Municipality of West Grey and other Ontario municipalities.
