The agreement entered into between landowners and Wind Power Pty Ltd permitting Wind Power Pty Ltd permits the developer to take a lease over the land at any time. The agreement reads like an option to lease but no option fee is paid a landowner for signing the agreement.

The VA SCC issued its final order that conditionally approves the Highland New Wind Development, LLC application to construct and operate a wind energy generating facility in Highland County, Virginia, near the West Virginia border. The proposed facility would consist of up to twenty (20) wind turbines of up to 2.00 MW capacity each. The order included comprehensive monitoring and mitigation for wildlife impacts (bird and bat) and could serve as a model for other projects. One of the commissioners dissented on a provision in the monitoring and mitigation plan.

This resolution by the Gillespie County Commissioners Court to oppose industrial wind energy in the county is very similar to the resolutions adopted by the Gillespie County Economic Development Commission and the City of Fredericksburg City Council.

On December 12, 2007, a special town meeting was held in Wilmington VT to determine the position the Selectboard should take on the Searsburg expansion project, also known as Deerfield Wind. The vote counts inserted below have been verified with the Wilmington Town Clerk.

Petitioners are residents and landowners in the Towns of Warren and Stark, who challenge two special use permits issued in June of 2007 by the respondent town boards authorizing the construction of the Jordanville Wind Power Project. This Article 78 petition seeks to annul and vacate actions taken and determinations made by the respondent town boards, alleging a violation of, inter alia, the State Environmental Quality Review Act (SEQRA) and the Open Meetings Law. The proposed project is for the construction a 68 turbine wind farm in the [*2]subject towns in Herkimer County which, when fully operational, will generate 136 megawatts of electric power from the wind which will be introduced into the New York State Electric Grid.

This resolution was adopted by the City of Fredericksburg in Gillespie County Texas.

The Department of Environmental Conservation has released for public review proposed Guidelines for Conducting Bird and Bat Studies at Commercial Wind Energy Projects. These guidelines inform potential wind developers of the information DEC needs about wind farm sites to assess impacts to birds and bats. The guidelines were developed through a stakeholder process sponsored by the New York State Energy Research and Development Authority which included industry representatives as well as bird and bat biologists from government agencies, academia and non-governmental environmental groups.
