** NOTICE OF PRESUMED HAZARD **
The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C., Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:
Structure: Wind Turbine Golden Wind Farm
Location: Beaufort, NC
Latitude: 34-46-39.88 N NAD 83
Longitude: 76-34-44.26 W
Heights: 340 feet above ground level (AGL)
344 feet above mean sea level (AMSL)
Initial findings of this study indicate that the structure as described exceeds obstruction standards and/or would have an adverse physical or electromagnetic interference effect upon navigable airspace or air navigation facilities. Pending resolution of the issues described below, the structure is presumed to be a hazard to air navigation.
If the structure were reduced in height so as not to exceed 0 feet above ground level (4 feet above mean sea level), it would not exceed obstruction standards and a favorable determination could subsequently be issued. Any height exceeding 0 feet above ground level (4 feet above mean sea level), will result in a substantial adverse effect and would warrant a Determination of Hazard to Air Navigation.

NOTE: PENDING RESOLUTION OF THE ISSUE(S) DESCRIBED ABOVE, THE STRUCTURE IS PRESUMED TO BE A HAZARD TO AIR NAVIGATION. THIS LETTER DOES NOT AUTHORIZE CONSTRUCTION OF THE STRUCTURE EVEN AT A REDUCED HEIGHT. ANY RESOLUTION OF THE ISSUE(S) DESCRIBED ABOVE MUST BE COMMUNICATED TO THE FAA SO THAT A FAVORABLE DETERMINATION CAN SUBSEQUENTLY BE ISSUED.
IF MORE THAN 60 DAYS FROM THE DATE OF THIS LETTER HAS ELAPSED WITHOUT ATTEMPTED RESOLUTION, IT WILL BE NECESSARY FOR YOU TO REACTIVATE THE STUDY BY FILING A NEW FAA FORM 7460-1, NOTICE OF PROPOSED CONSTRUCTION OR ALTERATION.

Additional information for ASN 2007-ASO-4416-OE
In accordance with Part 77.13, any/every structure exceeding 200 feet above ground level, requires notice to the FAA. We can not accept an application that is the center for 3 wind turbines - each WT has it's own site (lat/long) and site elevation, each needs to be studied. There are several issues with this current study. In addition to being in or near a military training route, this proposal exceeds Part 77.23(a)(3) TERPS criteria at MICHAEL J. SMITH FIELD (MRH), NC: LOC RWY 26 standard instrument approach (SIAP), minimum descent altitude (MDA) would be raised to 500 feet from current 380 feet. No effect height is 286 feet AMSL. With a certified site survey meeting FAA 2C accuracy standards the NEH is 290 feet AMSL. When proponent refiles for all 3 WT's, the impacts will be different for all 3.
