Wednesday afternoon Bingham County Judge Richard St. Clair notified attorneys for Ridgeline Energy they will have to re-apply for a special use zoning permit for a proposed 150 turbine wind farm in Wolverine Canyon.
According to a 38 page ruling there were several errors made during Ridgeline Energy's application process, making it necessary to extend an already lengthy process.
Judge St. Clair ruled two members of the planning and zoning commission had a conflict of interest while participating in public hearings making those procedures "unlawful" according to Idaho code.
He also ruled the planning and zoning commission was out of line when it formed a pre-development committee to approve sites for improvement on the 20,000 acre property.
This was a cause of concern for several land owners in the area. They felt Ridgeline's plans were too vague since they didn't indicate exactly where they were going to place several of their buildings.
This whole process started nearly two years ago. A representative from Ridgeline says they are disappointed with the ruling.
This could also hurt landowners who were counting on money from the wind farm.
Ridgeline says it plans to reapply for the permit.
